Abstract

ABSTRACT

Morocco has long remained on the margins of the international movement toward non-custodial sentencing. Law No. 43-22 on alternative sentences, published on 22 August 2024 and in force since 22 August 2025, adds community service, electronic monitoring, rights-restricting or rehabilitative measures and day-fines to the existing mechanisms of judicial supervision, fines, provisional release, suspended sentences and conditional release. This article treats the reform as a criminal policy whose performance is to be judged by its capacity to relieve prison overcrowding and to support the reintegration of offenders, and examines it from the standpoint of its implementation. It first maps the alternatives already provided by the Moroccan Penal Code and Code of Criminal Procedure, then analyses the architecture created by Law No. 43-22, its implementing decree and the circular of the Higher Council of the Judicial Power, and finally compares this framework with the more diversified French system of alternatives to pre-trial detention and to imprisonment. Based on the legal texts and on the first months of application, the analysis shows that the Moroccan reform reproduces, with some delay, the main categories known in comparative law, while its effectiveness is constrained by the cost of electronic monitoring, the shortage of host structures for community service, the training needs of judges and probation staff and incomplete coordination between institutions. The article concludes that the performance of Law No. 43-22 will depend less on its normative ambition than on the capacity of Moroccan institutions to provide it with stable resources, to apply it consistently and to monitor its effects over time; the French experience offers not a transferable model but an illustration of the sustained resources and judicial follow-up that non-custodial sentencing requires.
